It is time for the Committees on the Judiciary to form a Select Committee on Reform. We have to many laws and significant laws like the Patriot Act that require significant changes. No American should be subjected to overzealous prosecution that the Patriot Act allows.
A Joint Select Committee should also consider reforms to the plea agreement rules and the practice of piling on charges to promote pleas and deny citizens of access to a trial. Prosecutors want a 100% win rate, but as we saw with January 6th, that lead to denial of Brady Material and adding charges for grossly unrelated felony charges to facilitate plea agreements.
We have witnessed prosecutorial misconduct rather than the practice of discretion. Prosecutors should face severe penalties for coercion to achieve a plea deal. Many cases would be dismissed if they didn’t have the ability to pile on charges.
Lastly there needs to be Court Reform so that Circuit Courts remain bound within their jurisdictions. A court in Hawaii must not run roughshod over the entire nation because crafty attorneys judge shop and engaged in fantastical interpretation of the Constitution.
